As always, with the usual internet doing its thing, various early release code and Selected demo codes of the NXE have “leaked” out into the wild. Plus various offers of early code that have been floating around the net for a few weeks, comes this plan and simple warning from Microsoft Xbox – Division – DON’T install these files!
Warning: for those who do choose to download the files, copy them, have them loaded by legitimate owners or Licensed holders (those select few given the actual final code), you will face permanent bans and your 360′s suffer irreversible lock-outs which would basically render your Xbox 360′s un-usable. See above UPDATE
There were a limited number of Full Test Codes handed out to various media outlets so they could test and preview the NXE for their various publications and sites. These have been registered with that persons particular 360. No one else’s. So while they may transfer and work, they will not be recognized by XboxLive come the 19th and be banned and locked-out.
Some may have “leaked out” by other means, which is always the case. I have no idea why some of the “professionals” sign NDA’s in the first place, as they basically pay no attention to them, and they have no integrity around what they do sign anyhow. If they are willing to break something they sign and agree to, it says a lot about their level of personal integrity, or lack thereof.
If you have been offered, seen or tempted to download the NXE, just to see how it works, if you’ll like it etc, then WE WARN you now, DO NOT DO SO, and if some have loaded them – then we suggest that you remove them now. As come the 19th of November, you could find yourself with a nice looking, but very expensive door stop.

Major Nelson handed out some bad news for those who have updated their consoles with the leaked New Xbox Experience. Any unauthorized consoles that have the leaked update won’t be able to sign in until November 19- the date the update comes out to everyone else. This doesn’t apply to those who are part of the Preview Program, whose consoles will still function normally with the update. So, if you’re thinking of updating your console with the leaked verision, you’ll need to think to yourself: can you last 18 days without Xbox Live?

Leading to Major Nelsons Twitter item and his comments. Initially it was aimed at those who broke their embargo and aimed squarely at those ppl . .Unfortunately too many ppl got it, so now they are after those that were on the the early release list to find out who leaked it, and those ppl won’t be on any further testing programs, that’s for sure.
You can’t blame them really (MS that is) as after all, you entrust some ppl to do the right thing, have them sign NDA’s (non disclosure agreements) and then they simply ignor those agreements as if they weren’t even there.
SO I hope MS do penalize those that broke the NDA’s, they need to. But all is mute now, we have the NXE up and running, and it works a treat.

Oh sod off. I had to install this NXE dashboard just to be able to play games I PAID for without constant freezing and other problems caused by Microsoft’s crappy hardware. So now I deserve to be banned and treated like a pirate? I don’t care about their stupid new dashboard design, I just NEEDED to be able to install games to the harddrive so I can play them properly.

But yes, enough on this . . . let’s move on and see what the NXE brings us, we hope to have the ability to bring everyone a rundown on it, once we are given ‘permission’ to print it.

We were given the information from a MS FOrum Admin/Md. He had published it only moments befoire from advise from MS to do so.
We, as a community network followed suit.
We provide the link as he requested later on as a back up .
He then asked us to ad the last Update when he was told of the new news. SO Don’t go wagging the finger at us, we simply placed what we were asked to upo on the site. If you like, I could show you the emails and PM’s, but I don’t think I need to do that.
Plus the whole original item used the work COULD possibly face bans and there COULD be the chance that your 360 “may not work” after 19th. NOt that it WOULD happen and that ppl WOULD get banned.
Again, We printed what we were asked to do so, not make something up just for the hell of it. My personal opinion at the time was WTF, how could they, but that is not what we are here for. I’m happy they did clear it up publicily, and have now looked at ways to get those really responsible, rather than the end user.

@xboxoz360, You get all offended because people don’t read your update. Well, what did you expect after publishing an inflammatory article with flat out lies about potential bans? You have failed in your lies and responses and challenges to your lies to provide any links to the claims you have made that Microsoft said there would be bans. Further after being proven wrong you feel slighted and get rude when people don’t acknowledge your updates.
BTW – Here is a legit way to get the update while not in the program. Find someone who has the update legitimately, and attach their HDD to your console. Your console will get updated, but not be able to connect to Live. You were not in the program.
Lastly, you published this inflammatory article full of lies on November 3. It was already established and fact that Microsoft would not be banning on November 1. So, the only purpose of this article was full of lies and poor journalist integrity was to draw traffic to your site as doing so through good factual writing was not working for you.
We all make TYPOS every now and then, even EDGE magazine makes its fair share each month, so I think I’m aloud a few . .

Try reading . .As steve and this site has pointed out in an UPDATE, (at the very top and beginning of the article, where all UPDATES should go and be READ first – it now stands that if you have installed NXE, then you will not be able to connect too XBL, and come the 19th however, you “should” be able to do so without any fear of a ban . . . god, do ppl actually READ before hitting the keys on the keypad . . probably not.
Our job it to report what is directed to us by MS or their representatives, which we do. It was not fact. The fact was that if you upgraded to the NXE (not XNE) you will not be able to connect to Xbox Live until the 19th ov November.

And unless you do not know what an UPDATE is, it’s when a company re-thinks its moves and makes an “official statement” about a subject, which is not uncommon in the business, and many a report has been turned around due to public outcry. Which is why we report things in the FIRST PLACE.
At the time of going to press, the “Official Stand WAS what was reported. FACT. DO you think MS would have simply gone ahead with it’s plans if the public had not of made such a public fuss . .The forums lite up, the sites were sending url’s through and MS could see that the actions of a few, were in fact affecting many.
We were then given a first Update, which we reported and then finally and second one, which is no doubt in light of the concerns many were having around some idiots breaking their NDA”s.
It seems those responsible for breaking the NDA’s may well be the one punished, which I 110% agree with, rather than punish the end user who unwittingly uses a product.
So perhaps YOU might like to get YOUR facts right before sticking your soize 10 foot in it, and understand how the process works, instead of assuming how it works.
We are first and foremost a Xbox Community site, so we keep the community aware of things actually happening, not conjecture or rumours. These things are reported to us from MS, not by some other 3rd party.
We’re not in the business of making things up, it never helps anyone if a site does that . . .

That’s the problem see mate, no offence meant okay. But so many within the industry do NOT abide by the very rules laid down, an dthus spread that free-for-all approach as they have no regard for any terms or conditions they sign.
We on the other hand do, and believe that if we sign a NDA, that is what it means, None Disclosure Agreement . .and it’s 4-5 pages bloody long explaining every aspect of what you can and can not do, say etc.
The unfortunate thing is, these ppl pass stuff onto you, then do NOT tell them of what they signed for, and you don’t kbnow or believe there is anything attached to it. Much the same as when some fence passes off stolen gear to a 3rd party, he’s NOT going to say Hey mate, btw, don’t show this to anyone, I stole it . . hehehe but you get what I mean.
And that applies to all those who complain “but hey, I didn’t know – I’m a victim here” ,.. . well yes, and no. One, you need to know that if a company doesn’t make something “public” then sure as hell means that it is NOT meant to be out in the wild, and others have been give the PRIVILEGE of seeing it first or testing it out first – with conditions . make sense . .?!
SO as much as some might not like it, many of you have been scammed into taking something that really doesn’t belong to you, and that wasn’t meant for “public distribution” in the first place – yet.
And for those of you that believe everything should be FREE with no consequences for using it, then you’re fooling yourself. the world does NOT run or work like that, thanks god.
If it was Sony, Nintendo (both of which have solid NDA’s too I might add, and breaking those gets you in deep shite, that’s for sure. Anyone that breaks a NDA or an agreement with these firms by handing on material NOT meant for the general public is stealing goods knowingly, you on the other hand are receiving goods – all be it unknowingly. Which is WHY “receiving ” in the eyes of the law is seen as a higher crime than stealing . .
Again, no offense meant to anyone here, but in all honesty, no company , be it MS, Sony etc will just hand out their IP for anyone to use until they are ready. That is why it is after all called Intellectual Property . .

When we sign the NDA’s with MS, we have to do it in triplicate, so no excuse for saying “oh shit, I didn’t know that” . . it has to have every page of the 4 page doc initialled to say you read it . . .and 2 copies are sent back to MS, 1 to the local MS head Office, the other to the US head office in Redmond . . . .
Then, every writer on this site MUST sign a similar NDA so that we as the owners are also making sure the writers abid by the NDA’s, as if they do not, WE are held responsible for THEIR actions. SO each one has to do the same as we do . .

SO there’s no excuse that some clown broke his agreement and gove you a copy without telling any of you. He was the one that broke the law, but unfortunately, you’re the ones “using” the goods, which carries a stronger penalty as far as the LAW is concerned . . hope that helps clear things up a little. They cant ban us. Yeah i downloaded it, its really nice, aint gonna lie. If anything Microsoft should be excited that so many people actually want this update. id rather have people downloading thousands of copies of the internet than having no one want it. Its BS when you say were gonna get banned. I wish dey would try to ban me, especially when they said you wont be able to access it until Nov. 19! that would make Microsoft fat liars! Since so many people (i checked recently and the download button had been clicked over 10,000 times: on one website) have downloaded the update Microsoft would lose alot of customers and long time supporters to tha PS3!
Yeah, it makes sense, but it’s still a bummer for those of us who didn’t know any better. I didn’t even realize that the early participants had to sign an NDA.
Oh well, for now my 360 that has the NXE installed on it is staying unplugged from the internet until the 19th and I just hope I’m not permanently banned.

I agree mate, but at the same time, we were offered the XNE code, and as always, to those who it was offered to, it DID come with the “usual caveats” that being, that one must stick to the NDA’s we have signed.
Unfortunately, or fortunately as the case maybe, there were only 6 copies available here at that time, and MAJOR sites and publications get first crack at anything on offer, so we missed out.
We knew that it came with the NDA’s we HAVE to sign in order to participate in ANY MS (applies to Sony and Nintendo btw ppl) testing or information sharing. If you don’t sign it (NDA’s) then you don’t become part of the group or Testing Community etc.
Simple really. SO it’s “given” that those who get these things KNOW in advance that there ARE restrictions imposed. If you (anyone) gets it from someone who has broken those NDA’s, and THEY fail to tell you of the possible ramifications, then that is that persons fault for not telling you.
As MS (Sony or whomever) has already told the ‘original’ person who have signed NDA’s with MS (Sony etc) and MS etc have those back in their legal departments hand from their normal participants within the industry . . Does that make some sort of sense – sort of.
The only problem I have with this is that some people (myself included) downloaded and installed the NXE prior to them saying that they would ban people. I had read a copy of the e-mail posted above and didn’t think that it was that big of a deal to MS if it got installed to 360′s outside of the early release participants. Had I known that I could risk a possible permanent ban, I would have never installed it.
I have two 360′s and I only installed the NXE on one of them just to check it out. I just think that it would be really unfair to permanently ban people without telling everyone that they would do so prior to it being released to the early participants. Had MS told everyone prior to, then I would say that it serves everyone right if they get banned, but as it is, I don’t think it would be fair or a smart business move.
Or perhaps gamers should READ more before they use product that comes with conditions. . . . you can not blame a company for ones own inability to read and check out terms of use and if there are conditions attached. We knew there were conditions, it’s a given in the industry. You’re NOT in the industry, so it’s expected of you to read up on it, not MS/Sony etc to send you a personal email.
Because while it is IP, its not for sale and thereby not pirating! If you’ve got software that’s free, but still in beta stages and it gets leaked to fans, not rival opposition what would you do! You gonna slap the hand that feeds you! Its people like you that think this goody two shoes act is really righteous, but its not!
I have the NXE on my 360 and wouldn’t care if it got banned or not! Cause I’ve got another 360 in the wings, 2. I don’t play many online multiplayer games if ever! 3. I only use xbl to DL demos and look to see whos on and chat!

I mean, I’m not sellin it to people, nor am I trying to decipher the script and code that was written on it to make something better! And no I didn’t wanna wait 2 and a 1/2 wks, is it a crime! Yes, quite true, and that applies to those who have been REGISTERED with MS, and are in the program, NOT those outside the program and have got the code through “other means” . The item WE got straight from MS directly yesterday, post that notice btw, was that – yes, in some case (those outside that mentioned in your post) would in fact be banned and could end up with bricked 360′s . . .
So while in context with the PARTICIPANTS, the fact is they will not suffer any problems come the 19th November, those who are NOT part of the program,and those who get the code through nefarious ways will or could suffer problems. That’s from MS and up on their own MS main site and in their forums as of YESTERDAY.

Agree 110% mate . . .it also shows the level of disrespect many have for the legal papers they sign their name to when dealing with IP and “Insider Secretes”
A NDA is there for a reason, and if one puts ones name to it, it’s your integrity you are putting on the line.
If you break that agreement, then that says a lot about ones person integrity, or lack thereof. It urkes me to know that many that are trusted with final code of high AAA title games, that have signed and agreed to such NDA’s willingly and knowingly ‘steal’ the code and send it off onto the net . . .all for the sole purpose of being the first to have it up, yet these ppl are in high positions within a major firm . . why be there if they think so lowly of their profession. It just boggles my mind . .
More power to MS, Sony or whomever chooses to take these people to court, or impose bans and brick their hardware, they deserve it.

Why do they feel the urge to download it illegally and use it? The NXE hasn’t been made publicly available yet so if you download it off the net then you are illegally downloading it simple.

SO what you’re saying is that owning illegal product, IP, is perfectly fine and okay, and everyone should have the right to do so, and not pay for it if they choose to . righht.
It’s why it is called IP, because it “Belongs” to someone else, andthat code, is still subject to repair before release, and using it ‘could’ also do your console damage. Ever thought of that.
MS, Sony or anyone has the right to impose fines and or bans for aquiring their software through unapproved means, it’s the same with piracy . .which this is in its own way. Wait 15 days and get it for free without the hassles, and we, as an Xbox Community Site have every right to publish MS announcements . . it’s what we are here for in the first place.

The program was developed free! It was meant for everyone who owns a 360. Why in the world should they ban us for having a “PREVIEW” version!?
It’s like saying, Microsoft will ban people for using Windows Live 9 beta:/ When that program is free.
Please enough of all these “banning” stuff, they are just there to scare people. The reason why Microsoft allowed limited numbers of people, is so the rest won’t have a spoiler the day the NXE gets released.
It’s like Games developers, they decide to keep their mouth shut about a game, later reviewing little details of the game at different conventions. When the game finally gets released, users will have all the surprises and no spoilers.
If Microsoft bans people who owned the leaked version, they must be out of their mind.
In fact they would be saving us £40 a year! Because I work hard for my job, I use £40 just to play games online!
Plus a lot of people will just turn away.
The Leaked NXE only prevents you from using Xbox Live, that’s the downside!
